Sec. 15-351. - Required.
It shall be unlawful for any person or employee thereof to establish, set up, maintain, exhibit, conduct or carry on in the city any carnival, circus, fair, wild animal show, rodeo, traveling show or other similar or related type of amusement place unless a permit to do so has been issued as provided in this division and is full force and effect.

Sec. 15-352. - Application.
Any person desiring a permit required by this division shall make application therefor to the director of finance. The application shall be verified and shall set forth:
The director of finance shall transmit the application to the chief of police for approval or disapproval. The application must be filed no less than 30 days prior to the first scheduled date of activity.

Sec. 15-353. - Fees.
The application for a permit required by this division shall be accompanied by an application fee in the sum of $25.00. This fee is in addition to any business license fee which may be required to be paid. An employee application fee shall be established by the chief of police to defer any cost of the investigation required by this division. Application fees shall be retained by the city if the permit applied for is denied.

Sec. 15-354. - Exemption for city activities.
The city shall be exempt from the permit requirements set forth in this division.

Sec. 15-355. - Investigation of applicant; issuance.
The chief of police shall cause such investigation to be made of an applicant for a permit under this division as he deems necessary, and shall thereafter approve the issuance of such proposed permit. If, as a result of such investigation, the applicant's character (whether the applicant is an owner, operator or employee) or business responsibility is found to be unsatisfactory, or it is found that the proposed place of amusement is of such a character as to disturb the public peace or be injurious to good morals, or that the conducting thereof at the proposed location will disturb the peace and quiet of any persons residing in the vicinity thereof, the chief of police shall disapprove the application. The chief of police may in his discretion require the applicants to be fingerprinted and photographed. Upon approval by the chief of police of an application, the director of finance shall issue the permit. No permit issued pursuant to the provisions of this division shall be transferable.

Sec. 15-357. - Appeals.
Any person aggrieved by the action of the chief of police in approving or denying an application for issuance of a permit under this division, or in revoking or suspending or refusing to revoke or suspend any permit, may, within five days after such action, appeal to the city by filing written notice with the city clerk. The council shall then review the determination or decision of the chief of police in the matter appealed from and may approve, disapprove or modify such determination or decision. Such review shall be conducted no later than the next regular council meeting after the date of the filing of the appeal. The action of the council under this section shall be final and conclusive.
