Sec. 39.68. - Schedule of Loading and Unloading Zone Tag Permit Fees, Civil Penalties for Parking Violations, and Fee for Removal of an

(1)
There is hereby adopted the following schedule of fees for the acquisition of the first and additional loading and unloading
zone tag permits for which payment may be made at the Parking Bureau in accordance with Section 39.25 of this Chapter. The
additional tag permit fee must be paid for each tag permit purchased in addition to the first tag permit.

Where an act is prohibited or where an act is required but not performed, it shall be deemed to be a violation of this Chapter.
(4)
Where a civil penalty is not otherwise provided in Subsection (2) for a parking violation under this Chapter, the civil penalty
shall be fifteen dollars ($15.00).
(5) (a)Any person receiving a parking violation notice shall, within fourteen (14) calendar days, pay the civil penalty as prescribed
in Subsection (2) of this section or request a hearing before a designated official. Failure to pay the civil penalty as prescribed
in Subsection (2) or to request a hearing within fourteen (14) calendar days of the issuance of the parking violation notice
will result in the imposition of a delinquent fee of fifteen dollars ($15.00).
(b)
Any person electing to appear before the designated official shall be deemed to have waived his right to pay the civil penalty
as set forth in Section 39.68(2). The designated official, after a hearing, shall make a determination as to whether a violation
has been committed. If the commission of a violation has been proven, the designated official may impose a fine not to exceed
one hundred dollars ($100.00) plus court costs; provided, however, that for a violation of Florida Statutes § 316.1955 or
316.1956, or for a violation of City Code Section 39.16(q), the designated official may impose a fine not to exceed two hundred
and fifty dollars ($250.00) plus court costs.
(6)
If an individual who has received a parking violation notice for parking a motor vehicle in a parking space, the proper use
of which requires a specific permit or decal, appears at the offices of the Parking Bureau within fourteen (14) calendar days
of the date of such notice and furnishes proof that the required permit or decal was issued to such motor vehicle and that
such permit or decal was valid prior to the time of the violation, the Parking Bureau may reduce the civil penalty authorized
by Section 39.68(2) to five dollars ($5.00).
(7)
A fee of one hundred dollars ($100.00) is hereby imposed for removal of an immobilization device placed on a vehicle pursuant
to Sections 39.14, 39.29 and 39.30 of this Code.
(8)
To the extent permitted by the policies and procedures of the City, the Parking Bureau Chief shall have the authority to dismiss
parking violation notices and/or waive delinquent fees set forth in Section 39.68(5)(a); provided, however, that such dismissal
and/or waiver shall be appropriately documented with the reason(s) for dismissal or waiver placed in writing in the designated
files that bear the parking violation notice's citation number.

Sec. 39.69. - Procedures upon Non-Compliance with Parking Violation Notice.
(1)
The Parking Bureau shall accept payment of civil penalties for parking violations and issue receipts for such payments. The
Parking Bureau shall maintain a record of such civil penalties and shall daily report the monies collected and deposited in
the City's depository bank to the City Comptroller.
(2)
If any person summoned by a parking violation notice affixed on a motor vehicle does not respond to such notice within fourteen
(14) calendar days, the Parking Bureau shall assess the fifteen dollar ($15.00) delinquent fee per violation against the registered
owner of the motor vehicle as prescribed in Section 39.68(5)(a) of this Code, and a Notice of Summons shall be sent, by mail,
to the registered owner of the motor vehicle which was cited, informing such owner of the parking violation notice and the
failure to comply therewith. Such notice shall direct the recipient to respond within ten (10) calendar days; otherwise, a
Summons may be issued for failure to comply in violation of Section 39.70(1) of this Code.
(3)
If a response is not made within the time period specified in the Notice of Summons, a Summons may be issued commanding an
appearance before a designated official and a service of process charge of ten dollars ($10.00) per summons shall be assessed
and collected on behalf of the City of Orlando.
(4)
After issuance of Summons, a hearing on the charge of failure to comply shall be scheduled and such charge disposed of by
the designated official.
(5)
Any person who fails to respond to the original parking violation notice within the time period specified on such notice shall
be deemed to have waived the right to contest the merits of such parking violation and may, if found to have committed the
violation, be fined up to one hundred dollars ($100.00) for each parking violation notice for which there has been no compliance
and be fined up to two hundred fifty dollars ($250.00) for each parking violation relating to parking for persons with disabilities.
(6)
A violation of Section 39.70(1) of this Code shall be deemed a separate and distinct violation and shall not be construed
to be merged with or a part of the original parking violation.

Sec. 39.70. - Failure to Obey Notice; Alteration or Destruction of Notice Prohibited.
(1)
It shall be unlawful for the responsible party, as defined in Section 39.62 of this Code to neglect to answer to the charge
set forth in a parking violation notice affixed to a motor vehicle by a police officer, community service officer, parking
enforcement specialist, or City Code inspector.
(2)
The notice referred to in Subsection (1) of this section is and shall remain the property of the City before and after the
serving, delivery or affixing thereof. All persons receiving any such notice in writing, whether by personal service or by
affixing the same to a motor vehicle, shall be and are hereby required to preserve such notice and to bring and present or
otherwise transmit the same to the Parking Bureau when answering the charge set forth in such notice.

Sec. 39.71. - Altering Parking Tickets.
No person, whether the recipient thereof or otherwise, shall willfully throw away, alter, mar, mutilate, destroy or discard
the parking violation notice of the City. Any person violating this section shall be subject to the penalty as provided in
Section 1.08 of this Code.
Sec. 39.72. - Unlawful Use of Envelope Accompanying Notice.
It shall be unlawful for any person to place in the envelope, provided with and accompanying the parking violation notice,
any non-paper item or object. Paper items include the written notice, currency, and checks. Any person violating this section
shall be subject to the penalty provided in Section 1.08 of this Code.
Sec. 39.73. - Parking Violation Information to be Furnished to State Department of Highway Safety and Motor Vehicles.
The Parking Bureau is hereby authorized and directed to supply the State of Florida Department of Highway Safety and Motor
Vehicles with a listing of persons, in a State Department of Highway Safety and Motor Vehicles approved communications format,
who
have three (3) or more outstanding parking violations or one (1) or more parking violation(s) of Florida Statutes § 316.1955
or Florida Statutes § 316.1956, or any City ordinances which regulate similar parking in spaces for persons who have disabilities.
